To carry without a license, you must:

  • Be 21 years of age or older
  • Must not be prohibited from possessing a firearm in a public place under Texas Law. a) Not a felon b) Not convicted of assault family violence c) Not under specific protective orders
  • Within the past five (5) years, must not have been convicted of: a) Assault causing bodily harm b) Deadly Conduct  c) Making terroristic threats  d) Disorderly conduct- Discharging a firearm e) Disorderly conduct- Displaying a firearm
  • Must not be prohibited from possessing a firearm or ammo under federal law which includes: a)Not a felon b) Not a fugitive from justice c)Not an addict- a person who is an unlawful user of or addicted to any controlled substance d)Not considered mentally defective- been adjudicated as a mental defective or who has been committed to a mental institution. e)Illegal alien or non-exempt nonimmigrant alien f)Not dishonorably discharged from the armed forces g)Not renounced citizenship h)Not under specific protective i)Not a domestic abuser

    • Grounds where a school sponsored activity is taking place
    • Sporting events
    • Polling place, including early voting
    • Courts & offices used by the court
    • Racetrack where pari-mutuel wagering takes place: horse or dog racing
    • The secured area of airports (inside the metal detectors)
  • Within 1000 feet of an execution site on the day a sentence is to be imposed
  • Bars (51% locations)
  • Professional Sporting Events
  • Correctional facilities
  • Civil commitment facilities
  • Hospitals or nursing homes
  • Mental hospitals
  • Amusement parks
  • Room or rooms of an open meeting of a governmental entity
  • ANY place where the carrying of firearms is prohibited by federal law.

 

 

Where can you carry without a permit?

It’s difficult to spell out where permitless carry will be allowed. 

Rather, a person carrying under the Firearm Carry Act of 2021 without a permit can carry in locations OTHER THAN:

  • Federally banned locations
  • State banned locations
  • Locations legally posted as off-limits to all firearms
  • Locations legally posted as off-limits to unpermitted carry
